Legal Information

Transparency and protecting our customers are our priorities. Here you can find all legal information related to the use of our services.

1. GENERAL PROVISIONS

These General Terms and Conditions of Travel (hereinafter: the “General Terms and Conditions”) regulate the mutual rights and obligations between the travel organiser – BRIONI d.o.o. Travel Agency (hereinafter: the “Organiser”) and the users of services, i.e. passengers (hereinafter: the “Passenger”). Terms used in these General Terms and Conditions which have a gender-specific meaning apply equally to the male and female gender.

The General Terms and Conditions form an integral part of every travel contract concluded by the Organiser with the Passenger. The travel contract contains the specific travel conditions, including the travel programme, destination, duration, price, method of payment and other relevant information, while these General Terms and Conditions regulate the rights and obligations relating to registration, payment, cancellation, liability and other matters of general importance.

The Passenger may conclude a travel contract in person at the Organiser’s office, online or by other means of distance communication, in accordance with the applicable regulations of the Republic of Croatia and the European Union.

The travel contract shall be deemed concluded at the moment when the Passenger pays the deposit or the full price of the trip, after having previously been provided with all pre-contractual information required by law, including the Travel Programme, the General Terms and Conditions of Travel and the Standard Information Form for package travel. Payment of the deposit or the full price of the trip shall be deemed acceptance of the offer and makes the travel contract legally binding on both contracting parties.

These General Terms and Conditions apply to all package travel arrangements organised by the Organiser, unless expressly stated otherwise in the travel programme.

2. REGISTRATION AND PAYMENT

Based on the registration received, the Organiser shall provide the Passenger with a booking confirmation electronically. The booking confirmation contains essential information about the trip, including information about the contracting party, travel participants, travel programme, price, payment deadline and method of payment, and forms an integral part of the travel contract.

When concluding the contract, the Passenger is required to pay a deposit or the full price of the trip within the deadline and in the manner specified in the booking confirmation or travel programme. The Organiser has the right to withhold the service if it does not receive the appropriate payment by the agreed deadline:

  • upon registration, the passenger shall pay at least 40% of the value of the trip,
  • the remaining 60% must be paid no later than 30 days before the start of the trip, unless otherwise stated in the programme.

Payment of the deposit or the full price of the trip shall be deemed acceptance of the Organiser’s offer and makes the travel contract legally binding on both contracting parties, without the need for a handwritten signature.

If the Passenger pays in a currency other than euro, the European Central Bank middle exchange rate applicable on the date of payment shall apply. Bank transaction costs and any differences arising from exchange rate changes or fees shall be borne by the Passenger, unless otherwise agreed.

The contracting party concludes the travel contract both in their own name and on behalf of the other passengers listed in the booking and guarantees that all passengers are familiar with the Travel Programme, the General Terms and Conditions of Travel and the Standard Information Form for package travel.

Upon registration, the passenger is required to provide all information and documents required by the programme and to pay the deposit. If the passenger provides incorrect information, the passenger shall be responsible for all costs, i.e. consequences arising from such incorrect information. In this way, everything stated in the General Terms and Conditions and the programme becomes a legal obligation for both the passenger and the travel organiser.

Reservations “on request”

If there are no available places for a particular arrangement at the time of registration, the Passenger may request a reservation “on request”. In such a case, the Organiser may charge reservation costs amounting to 20% of the value of the arrangement for which the request was made, which are non-refundable.

The Organiser undertakes to process the request within 4 working days (where Saturday is not considered a working day) and to inform the Passenger of the result in writing or orally.

The deposit paid shall be refunded to the Passenger if the service cannot be confirmed, while if the Passenger does not accept the confirmed service, the deposit may be retained provided that all information required by law was previously provided.

Last Minute and Fortuna reservations

For “Last Minute” offers and arrangements booked under the “Fortuna system”, the Passenger must immediately pay the full price of the arrangement or ensure undisputed payment of the full amount of the arrangement.

3. PRE-CONTRACTUAL INFORMATION

Before concluding the contract, the Organiser shall provide the passenger with all pre-contractual information prescribed by the Tourism Services Act and Regulation (EU) 2015/2302, including:

– Travel Programme

– General Terms and Conditions of Travel

– Standard Information Form for package travel

Pre-contractual information shall be deemed to have been provided to the Passenger when it has been made available to them by email, through the Organiser’s website or by another appropriate means before conclusion of the contract.

The Organiser shall not be liable for any printing errors, errors on the website, or subsequent changes in new editions of promotional materials and programmes to which the Passenger’s attention was drawn before conclusion of the Contract, and in this respect the information stated in the Contract, rather than in promotional material which is considered pre-contractual information within the meaning of Article 29.* *of the Tourism Services Act, shall be deemed authoritative, but shall not form an integral part of the contract.

4. CONTENT AND PRICE OF THE ARRANGEMENT

The prices of arrangements are published in the travel programme, expressed in euros (EUR) and valid from the date of publication.

The price of the arrangement includes those services listed in the programme under “Price includes” and may also include various fees, where specifically stated in the programme. The price of the arrangement does not include services specifically listed in the programme under “Price does not include”, with a note that some optional services may be agreed in advance and shall be recorded in the Travel Contract.

All types of special services (single room, special diet, etc.) shall be paid for separately by the passenger and must be specified when booking the trip.

All mandatory fees and charges must be expressly stated in the travel programme. Optional services shall be stated and agreed before conclusion of the contract and entered as such in the offer.

Prices in the Organiser’s programmes are based on contracts with partners and do not necessarily correspond to prices published locally at the destination where the passenger resides/stays, and any difference in price may not be the subject of a complaint.

5. SPECIAL OFFERS / LAST MINUTE / “FORTUNA” TRAVEL

If the passenger has concluded a Travel Organisation Contract as a “last minute” trip or a contract under which the name of the accommodation in which the passenger will stay becomes known only upon arrival at the destination (offers under the names: fortuna, as, jocker, roulette, no name hotel and similar), the passenger accepts uncertainty regarding the exact location, accommodation facility and level of service within the published category. By doing so, the passenger accepts all reasonable risks associated with such arrangements, particularly with regard to aesthetic impression, location and certain additional facilities.

However, the Passenger retains the right to submit a complaint only if the facility or service materially deviates from the published category or represents a significant lack of conformity with the contract.

In the event of poor sales of an arrangement, the organiser reserves the right to reduce the price and to apply special marketing promotions in order to improve sales of the arrangement. Passengers who paid for the arrangement at the full price are not entitled to a refund of the difference in the arrangement price.

6. CHANGE OF THE AGREED PACKAGE TRAVEL PRICE

The Organiser may change the price exclusively in the following cases:

  • Increase in transport costs (fuel or another source of energy)
  • Increase in fees and taxes charged by third parties (e.g. airport charges, tourist taxes, etc.)
  • increase in accommodation prices affecting the price of the trip
  • Significant changes in exchange rates relevant to the arrangement

The Organiser has the right to unilaterally increase the price of the arrangement by up to 8% and inform the passenger thereof no later than 20 days before the trip. A price increase, regardless of its amount, is possible only if the Organiser informs the package traveller in writing, no later than 20 days before the start of the trip, of the price increase in a clear and understandable manner, together with a calculation and explanation of that increase. The Passenger undertakes to accept an increase in the agreed price of up to 8%,

If the agreed price increases by more than 8%, the Organiser is required to inform the package traveller in writing, no later than 20 days before the start of the trip, of the price increase in a clear and understandable manner, together with a calculation and explanation of that increase, and to specify a reasonable period within which the passenger must inform the Organiser whether they accept the proposed amendment or request termination of the Travel Contract, which period depends on the circumstances of each individual case and may not be shorter than 2 days.

The Passenger has the right to terminate the travel contract, provided that they notify the Organiser thereof in writing within the deadline specified in the notice. If the passenger does not submit their withdrawal to the Organiser in writing and within the specified deadline, the contract shall be deemed terminated. In the case of airline tickets, airport charges are subject to change until the date of issue of the airline ticket. In the event of an increase in airport charges, the passenger shall bear the difference in price. The Passenger is entitled to a price reduction corresponding to any reduction in the costs referred to in this Article occurring after conclusion of the Contract and before the start of the package travel arrangement. In the event of a price reduction, the Organiser has the right to deduct from the refund due to the passenger the administrative costs actually incurred.

7. OBLIGATIONS OF THE ORGANISER

The Organiser is required to ensure the performance of services and the selection of service providers with the diligence of a prudent businessperson and to protect the rights and interests of passengers in accordance with good practices in tourism. The Organiser is required to provide the passenger with all services agreed for an individual arrangement and to provide answers regarding any failure to provide services or part of the services. The Organiser shall perform all obligations stated in its programmes fully and in the manner described, except in the event of force majeure or unforeseen circumstances. If, after the start of the trip, significant contracted services cannot be provided, the Organiser is required to offer the passenger appropriate alternative arrangements without additional costs to the passenger, unless it is impossible to provide such a substitute service. The Organiser is not required to provide services outside these General Terms and Conditions.

8. TRAVEL DOCUMENTS AND OTHER OBLIGATIONS OF THE PASSENGER

The Passenger is required to possess valid personal travel documents. When concluding the Contract, the passenger is required to provide personal data and timely submit all documentation and information necessary for organising the trip in person at the Agency or by email.

The Passenger is required to inform the Organiser of all facts relating to their health, habits, etc. which could jeopardise the conduct of the trip (if, for health or other reasons, they require a specific type of food, suffer from a chronic illness, allergies, reduced mobility, etc.). Certain trips may have special health requirements, including mandatory vaccinations and appropriate documentation. The Passenger is required to obtain the necessary vaccinations in due time and ensure that they possess valid certificates thereof. The Organiser shall not be liable for possible complications that may arise due to failure to comply with health regulations or failure to disclose relevant information before the trip.

For all travel abroad, taking out a travel health insurance policy is recommended.

If a visa is required for a particular trip, the Organiser may (if the visa-issuing authority permits representation) assist in obtaining it for an additional fee, but shall not be responsible for decisions of official authorities resulting in refusal of entry into a particular country/countries. Failure to obtain a visa or invalid travel documents resulting in cancellation of the trip shall in no way bind the Organiser, and the Organiser reserves the right to charge compensation for damages as specified in these General Terms and Conditions.

When concluding the Travel Contract, we recommend that every Passenger personally obtain information via the official website of the Ministry of Foreign and European Affairs of the Republic of Croatia (www.mvep.hr) regarding travel conditions, visa requirements and any security risks in the country to which they are travelling.

The Passenger is required to comply with customs, foreign exchange and other regulations, as well as the laws and other subordinate legislation of the Republic of Croatia and other countries through which they travel and in which they stay. If continuation of the journey becomes impossible due to the Passenger’s violation of regulations, all resulting costs and consequences shall be borne by the offender. If travel documents are lost or stolen during the trip, the cost of obtaining new documents shall be borne by the passenger. The Organiser’s tour escort shall assist the passenger in such a situation, while taking into account the normal continuation of the travel programme. The Passenger may not hold the Organiser liable for costs or any damage suffered on this basis. The Passenger is responsible for ensuring that they personally, their documents, luggage and belongings comply with visa, border, customs, health and other regulations of both the Republic of Croatia and the country to and through which they travel, for complying with house rules in hospitality and hotel facilities, and for cooperating in good faith with the representative of the travel organiser (tour escort or guide) and service providers. In the event of failure to comply with the above obligations, the passenger shall be liable for any damage caused, and the Organiser excludes all liability therefor. In such a case, the passenger shall settle the amount of the damage with the owner of the facility (hotel, apartment, etc.) at reception.

The Passenger is required to comply with the rules of conduct in accommodation facilities and means of transport and must not, by their actions, prevent the smooth implementation of the travel programme or jeopardise the rights of other passengers in using the Organiser’s services. The programme cannot be adapted to individual wishes.

The Passenger must behave appropriately and refrain from any form of harassment, pressure, insults or interference with the tour escort, guide, driver or other passengers.

The Organiser has the right to warn or, in more serious cases, remove a passenger from the trip without refund of the amount paid if their behaviour jeopardises safety, the implementation of the programme or the well-being of other participants. In such a case, the trip shall be deemed to have been interrupted at the Passenger’s request, and the Organiser shall not be required to bear the costs of returning the Passenger to the departure point. If the passenger is a minor, i.e. a child, the parent is required to accept the child’s return home or collect their child at their own expense.

The Passenger shall be liable for all damage caused by their inappropriate behaviour.

The Passenger is required, without undue delay and taking into account the circumstances, to inform the Organiser of any lack of conformity identified during the performance of a travel service included in the package travel contract. If any travel service is not performed in accordance with the package travel contract, at the Passenger’s request Brioni d.o.o. is required to remedy that lack of conformity, unless this is impossible or if remedying the lack of conformity would entail disproportionate costs, taking into account the extent of the lack of conformity and the value of the travel services affected.

If Brioni d.o.o. does not remedy the lack of conformity of services in accordance with the contract, the Passenger is entitled to a price reduction and/or compensation for damages in accordance with Articles 43 and 44 of the Tourism Services Act.

9. PASSENGER’S LUGGAGE

The carriage of luggage up to a certain weight prescribed by the carrier is included in the price of the trip, according to the rules

The permitted luggage weight included in the price of arrangements involving air travel depends on the airline and shall be specifically stated in the final travel notice. Excess luggage shall be paid for by the passenger in accordance with the applicable rules and prices of the carrier. For the transport of special luggage, such as bicycles, surfing or golf equipment, the passenger is required to pay additional costs to the carrier, generally at departure. In any event, the carriage of such luggage must be announced at the time of booking. Regardless of the above, due to limited capacity the carrier shall in any event have the right to refuse carriage of such special luggage. All costs or damage that may arise as a result shall be borne by the passenger.

Children under two years of age are entitled to free carriage of luggage. The organiser, agent or intermediary is not responsible for the carriage of luggage. The Organiser accepts no responsibility for lost and/or damaged luggage. Any irregularity relating to luggage, including but not limited to delay, loss and/or damage to luggage, shall be reported by the Passenger without delay directly to the carrier if the irregularity occurred during transport, or to the hotel if the irregularity occurred during the stay. In air transport, checked luggage is the responsibility of the air carrier to which the luggage was handed over for transport, in accordance with the regulations applicable to air transport, while the Passenger is personally responsible for hand luggage, including luggage marked “Delivery at Aircraft” and temporarily placed in the luggage compartment. In the event of an irregularity, the Passenger shall submit an irregularity report directly to the carrier or to an agent authorised by the carrier to deal with irregularities in luggage transport. Based on that report, the carrier shall pay compensation in accordance with the regulations applicable to domestic and international passenger air transport. In the event of loss, damage and/or theft of luggage at a hotel, the Passenger shall submit a claim for compensation to the hotel where the luggage was lost, damaged and/or lost. The Passenger is responsible for looking after their belongings and luggage brought into the passenger cabin of the means of transport (aircraft, bus, train, ship, etc.) and is required to take them with them whenever leaving the means of transport. We recommend taking out luggage insurance.

10. ORGANISER’S RIGHT TO CANCEL THE TRIP OR CHANGE THE PROGRAMME

If the minimum number of passengers required for a particular trip is not reached,, the Organiser has the right to cancel the trip as follows:

a) for trips lasting more than 6 days – no later than 20 days before the start of the trip
b) for trips lasting between 2 and 6 days – no later than 7 days before the start of the trip
c) for trips lasting less than 2 days – no later than 48 hours before the start of the trip.

In the event of cancellation for the above reasons, the Organiser is required to refund the Passenger the full amount paid without undue delay, and no later than 14 days from the date of termination of the package travel contract, using the same method by which payment was made, unless the contracting parties agree otherwise, provided that the Passenger has supplied the Organiser with the information necessary for the refund. The minimum number of passengers required for each trip is specifically stated for each programme / arrangement.

If, after conclusion of the contract, extraordinary and unavoidable circumstances arise which the Organiser could not foresee, avoid or remedy, the Organiser has the right to make necessary changes to the travel programme, of which the Passenger shall be informed without delay.

If it is necessary to change the day or time of travel due to changes to flight schedules, traffic restrictions, the security situation in a particular country, natural disasters or other extraordinary and unforeseeable circumstances beyond the Organiser’s control, the Organiser has the right to make appropriate adjustments to the programme or unilaterally terminate the contract in whole or in part. In such a case, the Passenger is entitled to a full refund of the amount paid or the difference in price between the contracted and provided services.

The Organiser shall not be liable for delays of aircraft, ships, trains or other means of transport resulting from circumstances beyond the Organiser’s control, and the Passenger shall exercise any rights arising from passenger transport regulations (including rights under European Union regulations) directly against the competent carrier.

In the event of a delayed connecting flight resulting in a missed onward flight, responsibility shall lie with the air carrier in accordance with air transport regulations, while the Organiser shall provide the Passenger with appropriate assistance within the limits of its legal obligations.

In the event of overbooking on a flight, the Passenger is required to cooperate with representatives of the air carrier in order to find an appropriate solution.

If circumstances at the destination prevent the Passenger from being accommodated in the contracted facility, the Organiser shall, at its own expense, accommodate the Passenger in another facility of the same or a higher category than that contracted.

In the event of extraordinary and unavoidable circumstances arising during the trip, the Organiser shall not be liable for damage arising exclusively as a consequence of such circumstances, but shall, in accordance with applicable regulations, provide appropriate assistance to the Passenger and ensure the performance of services within the possibilities available in the specific circumstances.

The order of performance of the travel programme (itinerary) may be changed depending on traffic conditions, weather conditions, security reasons, optimisation of services for passengers, opening hours of individual facilities, the assessment of the tour escort or other circumstances beyond the Organiser’s control. Such changes shall not be considered a material amendment to the contract if the overall content of the trip remains unchanged.

As an additional service, the Organiser may allow passengers to select a particular seat in the means of transport for an additional fee. Seat selection is subject to availability and confirmation at the time of booking. Failure to select a seat does not affect the quality or performance of the contracted transport service.

11. PASSENGER’S CANCELLATION OF THE TRIP

If a passenger terminating a package travel contract finds another person who fulfils all conditions for participation in the trip and accepts all rights and obligations under the contract, the Organiser shall allow the contract to be transferred, provided that it is informed thereof no later than 7 days before the start of the trip. In that case, the Organiser has the right to charge only the actual costs caused by replacement of the passenger.

The Passenger has the right to terminate the package travel contract at any time before the start of the trip, in writing, in which case the Organiser has the right to an appropriate and justified termination fee according to the scales below.

The Passenger has the right to terminate the package travel contract at any time before the start of the trip, in writing, without payment of a fee, in the event of changes to essential elements of the arrangement other than the price and in the event of extraordinary and unavoidable circumstances occurring at the destination or in its immediate vicinity which significantly affect the performance of the package travel arrangement or the carriage of passengers to the destination, in accordance with applicable regulations. Illness of an individual passenger shall not be considered an extraordinary circumstance.

The Organiser recommends that passengers take out travel cancellation insurance.

If the passenger cancels or shortens the trip due to weather conditions at the destination, including lack of snow, such termination shall be considered termination at the Passenger’s initiative and the termination fee scales below shall apply.

Termination fee scales:

If the Passenger fails to pay the remaining amount of the arrangement price or provide valid documentation for payment of the full arrangement price no later than 30 days before the start of the trip, the Passenger shall be deemed to have terminated the contract, and the Organiser shall have the right to retain the deposit paid.

Airline tickets and individual travel

In the event of cancellation of an airline ticket by the passenger, the passenger shall bear the airline ticket cancellation cost, which is 100%. For individual travel, where vouchers for accommodation and other services have been issued, cancellation costs depend on the terms and conditions of the relevant suppliers. For these reasons, we recommend taking out cancellation insurance.

12. CATEGORISATION AND DESCRIPTION OF SERVICES

Hotels, apartments or other facilities offered in the programmes are described according to the official categorisation of the relevant country applicable at the time the programme was issued. Please note that local categorisation differs significantly in certain countries. Comfort, meals, the contents of the accommodation unit and other services are under the supervision of local and national tourism authorities, and accommodation and service standards vary and are not comparable. The Organiser accepts no responsibility for any written or oral information which is inconsistent with the description of services and facilities in the published programmes and which has been provided either by an employee of the Organiser or by a third party. If the Passenger uses a triple or multi-bed hotel room, the hotelier will most often provide a double room with an extra bed. The quality of the auxiliary (extra) bed depends entirely on the hotel. Under no circumstances shall the Organiser be liable for any matter concerning the quality of an extra bed, and any dissatisfaction of the Passenger arising for these reasons may not be the subject of a complaint.

13. ACCOMMODATION IN ROOMS / APARTMENTS

Allocation of accommodation in rooms/apartments is determined by the reception of the accommodation facility at the place of stay. Unless the Passenger has expressly contracted a room/apartment with specific characteristics, the Passenger shall accept any officially registered accommodation unit in the particular facility or destination described in the travel programme, catalogue and price list. Where possible, the Organiser shall attempt to satisfy the Passenger’s advance accommodation request (baby cot, room orientation, floor, etc.), but cannot guarantee that such a request will be fulfilled. Accommodation is generally not available before 3:00 p.m. on the first day of the service and must be vacated by 10:00 a.m. on the final day of the service. Arrivals after 7:00 p.m. must be announced in advance unless otherwise stated. The decision regarding earlier check-in and/or later check-out from the accommodation unit is made independently by the accommodation facility and the Organiser has no influence over it.

If the accommodation service provided is not in conformity with the travel contract, the Passenger is entitled, without additional cost, to correction of the lack of conformity or an appropriate substitute service of the same category, where possible. If the lack of conformity cannot be corrected within a reasonable period, the Passenger is entitled to a price reduction and/or compensation for damages, pursuant to Art. 43–24 of the Tourism Services Act and Art. 13 of Regulation (EU) 2015/2302.

14. TRAVEL INSURANCE

By signing the Travel Contract, including through other actions deemed to constitute conclusion of the contract, it shall be deemed that the Passenger has been offered and recommended travel insurance, namely: voluntary travel health insurance, accident insurance, insurance against damage to and/or loss of luggage, travel cancellation insurance and third-party liability insurance, and that information regarding the scope of such insurance and the insurer’s terms and conditions has been made available to the Passenger.

The Passenger may take out a travel insurance package or individual insurance policies through Brioni d.o.o. Travel Agency (the Organiser) or independently, directly with any insurance company. If insurance is taken out through the Organiser, the Organiser acts solely as an intermediary for the insurance company, while rights and obligations under the insurance contract are always concluded directly between the Passenger and the insurer.

Travel cancellation insurance may be taken out exclusively within 48 hours of conclusion of the Travel Contract or purchase of an excursion ticket, in accordance with the insurance company’s terms and conditions, and after expiry of that deadline it cannot subsequently be arranged through the Organiser.

If the Passenger fails to provide all information required for issuing the insurance policy within the deadline, it shall be deemed that the Passenger does not wish to take out travel insurance or will arrange it independently.

The insurance premium is determined according to the insurance company’s price list, depending on the type of insurance, duration and price of the trip. Valid reasons for cancellation of the trip and the scope of coverage are determined exclusively by the insurance company in accordance with the terms and conditions of the insurance contract.

Insurance premiums paid do not form part of the package travel arrangement, are not refundable in the event of cancellation of the trip, and shall not be refunded, nor shall the costs of obtaining visas and reservation services, regardless of whether the Passenger has travel cancellation insurance.

In the event of cancellation of the trip, the Organiser has the right to charge an appropriate termination fee pursuant to the provisions of point 10 of these General Terms and Conditions.

In accordance with Regulation (EU) 2015/2302 and the Tourism Services Act, the Organiser has fulfilled its obligation to inform the Passenger of the possibility of taking out travel insurance covering the costs of contract cancellation and assistance costs, including repatriation in the event of accident, illness or death. Such insurance is not included in the basic price of the trip and is contracted as an additional, optional service.

15. GIFT VOUCHERS

A gift voucher is a means of payment in paper form and is numbered with a unique number when issued. The issuer issues it upon payment of funds made by the user, who also determines the amount. The gift voucher can be used for group or individual travel or any other service offered by the Organiser (hotel accommodation in Croatia and abroad, etc.). The amount on the gift voucher is valid until the date stated on the gift voucher; after expiry of that period, the amount on the gift voucher cannot be used. Payment of an amount already paid onto the gift voucher is not possible. By paying the amount, the user accepts the Organiser’s General Terms and Conditions relating to the gift voucher and shall be deemed familiar with them.

Personal data of users collected when purchasing a gift voucher shall be used exclusively for the performance of the service and shall not be disclosed to third parties, in accordance with the General Data Protection Regulation (GDPR).

If the amount of the service is lower than the value of the gift voucher, the remaining amount may be used until expiry of the voucher’s validity period. If the amount of the service is higher, the user shall pay the difference using another means of payment.

16. INSURANCE IN THE EVENT OF INSOLVENCY OR BANKRUPTCY OF THE TRAVEL ORGANISER

Pursuant to the Tourism Services Act, the Organiser has insurance in place in the event of insolvency or bankruptcy of the travel organiser, securing the refund of amounts paid by passengers and repatriation of passengers who are already travelling.

In the event of insolvency or bankruptcy of the travel organiser, passengers who have paid a deposit and/or the full amount of the arrangement, as well as passengers already travelling, are required to contact the insurer without delay:

Allianz Hrvatska d.d.

Heinzelova 70, 10000 Zagreb

Package travel organiser guarantee insurance policy number: 1500-176944101

Telephone: 072 100 001

When submitting a claim, it is necessary to provide an address or telephone number through which the insurer can contact the Passenger. These General Terms and Conditions serve as confirmation that insurance has been taken out in the event of insolvency or bankruptcy of the travel organiser.

17. LIABILITY INSURANCE

Pursuant to the Tourism Services Act, Brioni d.o.o. has concluded a liability insurance policy with Allianz Hrvatska d.d. covering damage that the Organiser may cause to the Passenger as a result of failure to perform, partial performance or improper performance of obligations relating to package travel arrangements.

Liability insurance policy number: 1500-176944101.

18. COMPLAINT RESOLUTION AND SUBMISSION PROCEDURE

The Passenger has the right to submit a complaint regarding a contracted service that has not been performed or has been only partially performed.

The Passenger is required, without undue delay and already during the trip, to inform the Organiser or service provider (reception, carrier, hospitality provider or travel agency at the destination) and request confirmation that the complaint has been received. If, due to objective circumstances, it was not possible to submit a written complaint on the spot, the Passenger retains the right to submit a complaint within the deadline stated below.

The Passenger shall submit a written complaint to the Organiser within 8 days of completion of the trip. The complaint shall be submitted in writing by email, post or personal delivery.

Each passenger – holder of the contract submits a complaint on their own behalf.

The Organiser is required to issue a written response to a received complaint within 15 days of receipt of the complaint, using the same method by which the complaint was received.

If, through the fault of the Organiser, the trip or part of the contracted services has not been performed or has been improperly performed, the Passenger is entitled to a proportionate price reduction and/or compensation for damages, in accordance with applicable regulations. Compensation applies exclusively to services that were not performed or were improperly performed and may not include services that were duly performed.

For contracts concluded under special conditions (last minute, fortuna, roulette, no name, joker and similar programmes), the Passenger accepts uncertainty regarding the selection of the accommodation facility or other variable elements of the offer, but this does not exclude the Organiser’s liability for performance of the contracted services in accordance with applicable regulations.

In the event of a dispute relating to a contract concluded online, the consumer may use available mechanisms for alternative and judicial resolution of consumer disputes in accordance with the applicable regulations of the Republic of Croatia and the European Union.

19. PERSONAL DATA PROTECTION

As the data controller, the Organiser collects and processes passengers’ personal data exclusively for the purpose of performing the travel contract and providing the contracted services, in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR).

For the above purpose, personal data may be provided to third parties (service providers, insurers and partners in Croatia and abroad) where necessary for the performance of the service.

All employees of the Organiser and business partners are required to comply with privacy protection rules. Data is stored in a protected database for as long as necessary to fulfil the purpose for which it was collected or for as long as required by law.

The Passenger has the right to access their data, rectify it, erase it, restrict its processing, object to processing and exercise the right to data portability. To exercise their rights, the Passenger may contact us by email at: turizam@brioni.hr

For marketing purposes, data is used exclusively with the Passenger’s consent, and the Passenger may unsubscribe from the list of recipients of promotional messages at any time.

20. TRAVEL CONDITIONS FOR LINKED TRAVEL ARRANGEMENTS

The General Terms and Conditions of Travel for package travel arrangements do not apply to travel under a linked travel arrangement, except in the part relating to the protection of passengers in the event of the Organiser’s insolvency, in accordance with applicable regulations.

A linked travel arrangement means at least two different types of travel services purchased for the purpose of the same trip or holiday which do not constitute a package travel arrangement (for example, an individual booking of accommodation, transport, transfer or other additional services).

In the case of linked travel arrangements, the Organiser facilitates the contracting of individual travel services, while each individual service provider is solely responsible for proper performance of its service in accordance with the contract.
