General Conditions for the Carriage of Passengers, Luggage and Items
Pursuant to Article 4(1)(31) of the Road Transport Act (Official Gazette No. 41/18), Brioni d.o.o. Pula hereby adopts the following:
General Conditions of Carriage of Passengers
I GENERAL PROVISIONS
Article 1
These General Conditions of Carriage of Passengers regulate the conditions under which the Carrier provides passenger transport services, in particular: the rights and obligations of the Carrier and passengers in connection with the performance of the contract of carriage; rules governing the conduct of vehicle crew when providing transport services; the conduct of vehicle crew towards passengers; rules of conduct for passengers during transport; conditions of carriage and the rights of persons with disabilities and persons with reduced mobility during transport; rules governing the carriage of luggage; and rules governing the carriage of animals.
Article 2
For the purposes of these General Conditions, the following terms shall have the following meanings:
CARRIER means Brioni d.o.o. Pula, Šijanska cesta 4.
PASSENGER means a person transported by the Carrier for a fare.
DOMESTIC ROAD TRANSPORT means transport within the territory of the Republic of Croatia.
TRANSPORT WITHIN THE EUROPEAN UNION means transport between two or more Member States of the European Union (hereinafter: EU), including the Swiss Confederation.
INTERNATIONAL ROAD TRANSPORT means any transport between an EU Member State and a non-EU country.
VEHICLE means a bus or a vehicle with at least nine seats, including the driver's seat, intended exclusively for the carriage of passengers.
TICKET means a document entitling the passenger to transport by the Carrier under the conditions set out in these General Conditions of Carriage.
Article 3
The Carrier shall apply these General Conditions for the carriage of passengers, luggage and items in accordance with the established fares for each route or transport service.
Article 4
The fare for the carriage of passengers and luggage in public road passenger transport shall be determined by the Carrier.
II CONTRACT OF CARRIAGE
Article 5
By purchasing a ticket, the passenger enters into a contract of carriage with the Carrier.
The Carrier undertakes to transport the passenger safely on the agreed route, using the means of transport specified in the contract of carriage and under conditions of comfort and hygiene considered necessary according to the type of vehicle and the distance travelled.
The contract of carriage is concluded between the Carrier and the passenger or between the Carrier and the person ordering the transport service, in which case the person ordering the transport service assumes the obligation to pay the transport fare.
The existence of a contract of carriage shall be evidenced by a ticket or a separate contract.
Article 6
The Carrier shall provide a passenger holding a valid ticket and reservation with a seat in the vehicle and transport them on the agreed route according to the published timetable. The passenger must keep the ticket throughout the journey and present it upon request to an inspector or member of the vehicle crew.
Article 7
The ticket is issued to the bearer and contains the date and time of issue, the route for which it is issued, the fare, and the date and time at which the journey begins.
A ticket for international transport may be issued in the passenger's name and, in addition to the information specified in paragraph 1 of this Article, may contain the passenger's first and last name.
A ticket issued in a passenger's name may not be transferred to another person without the Carrier's consent.
A ticket that does not contain one of the elements specified in paragraphs 1 and 2 of this Article shall be invalid.
Article 8
As a rule, a ticket is issued for a single journey and is binding on the Carrier for the date, time and route stated on the ticket.
A passenger may also purchase a return ticket. The period of validity shall be stated on the return ticket. The validity period of the return portion of the ticket shall be calculated from the date on which the outbound journey begins.
A return ticket entitles the passenger to outbound and return transport on a predetermined route.
A passenger using the return portion of a return ticket must reserve a seat for the return journey.
Return tickets are valid on the Carrier's vehicles and on the vehicles of other carriers with which the Carrier jointly operates transport services on certain routes.
Article 9
Notwithstanding Articles 7 and 8 of these General Conditions, a passenger may purchase a travel pass by paying a one-off fee in accordance with the Carrier's applicable price list.
A travel pass is issued in the holder's name and contains information about the holder and the type of pass.
A travel pass is issued for a specified period stated on the pass, which may be half-monthly, monthly, multi-monthly or annual.
The Carrier determines the fee for the travel pass according to the category of passenger using it (pupils, students, employees or pensioners) and the conditions under which it is used.
Travel passes are sold at the Carrier's points of sale.
If a travel pass is damaged, lost, stolen or otherwise rendered unavailable, the passenger shall bear the cost of issuing a new travel pass.
A month shall be calculated as a calendar month, from the first to the last day of the month.
If a travel pass is lost, the holder must immediately report the loss to the point of sale where it was purchased in order to prevent possible misuse and allow the Carrier to cancel it promptly.
Article 10
Tickets may be purchased at authorised points of sale (bus stations, bus stops, agencies, branch offices, the Carrier's vehicles, etc.) and online.
A ticket may be printed electronically or completed manually. An online ticket may also be presented in electronic form (PDF file) together with a valid official identification document.
Notwithstanding paragraph 1 of this Article, a ticket may also be purchased on board the vehicle:
- where the passenger boards at a registered stop on a route operated by the Carrier and no ticket sales facility is available at that stop;
where the passenger arrives immediately before the vehicle's scheduled departure and the vehicle crew cannot direct the passenger to an authorised point of sale because doing so would delay the departure of the service.
Article 11
A passenger may reserve a seat on the bus through authorised points of sale by telephone, in writing, by email or by another appropriate method. The passenger must purchase the ticket and reservation no later than six hours before the start of the journey for international regular transport and transport within the EU, or two hours before the start of the journey for domestic regular transport.
If the passenger does not purchase the ticket within the period specified in paragraph 1 of this Article, the point of sale may sell the reserved seat to another passenger. The original passenger shall lose the right to the reserved seat and shall not be entitled to claim compensation from the Carrier.
For objectively justified reasons, the Carrier reserves the right to change the seat number stated on the reservation on certain routes, provided that a seat is made available to the passenger holding a valid reservation.
A passenger travelling with a child who uses a child safety seat must inform the Carrier of this fact when purchasing the ticket, and no later than 48 hours before the start of the journey.
Article 12
A reservation shall not be issued without the purchase of a ticket, except where the passenger holds a return ticket, travel pass or concessionary ticket.
A seat reservation fee shall be charged in accordance with the applicable price list of the Carrier or bus station.
For routes of up to 50 kilometres from the point of departure, the Carrier shall issue a reservation for a purchased ticket only at the passenger's request.
A seat reservation fee shall also be charged in accordance with the applicable price list of the Carrier or bus station where seats are not numbered on certain routes.
Article 13
The Carrier may, by a separate decision, grant commercial discounts for individual routes, individual departures on certain routes or particular categories of passengers (e.g. according to age, disability, pupil or student status, etc.).
Article 14
A passenger has the right to withdraw from the contract of carriage before the journey begins.
The Carrier shall refund the fare paid by the passenger, less a 10% administration fee, provided that the passenger cancels the journey:
- for domestic regular transport, no later than two hours before departure;
- for international regular transport and transport within the EU, no later than six hours before departure;
- for occasional transport, no later than 48 hours before departure.
If a passenger requests a refund for the unused portion of a return ticket before the return ticket expires, the Carrier shall refund the difference between the price of the return ticket and the full one-way fare without commercial discounts, less a 10% administration fee.
If a passenger requests a refund for the unused portion of a return ticket that includes an additional commercial discount before the return ticket expires, the Carrier shall refund the difference between the price of the return ticket and the one-way fare including the applicable commercial discount, less a 10% administration fee.
If the passenger fails to comply with paragraphs 2 and 3 of this Article, they shall lose the right to a refund of the fare in full.
Article 15
If a passenger purchases a travel pass and subsequently cancels it, they may request a refund from the Carrier.
If a refund is requested before the beginning of the month for which the travel pass was purchased, the amount paid shall be refunded less a 10% administration fee.
If a refund is requested during the month, meaning that the travel pass has been partially used, the refund shall be calculated by deducting the number of days used at the full applicable fare from the date of cancellation (excluding Saturdays, Sundays and public holidays), as well as a 10% administration fee.
A request for a justified partial refund (e.g. due to illness) for an unused travel pass may be submitted during the month and no later than the fifth day of the following month.
A request referred to in the preceding paragraph may only be submitted for a period of at least five consecutive days, excluding Saturdays, Sundays and public holidays, and must be accompanied by appropriate supporting documentation.
In the circumstances referred to in paragraphs 4 and 5 of this Article, the passenger shall receive a refund based on the price of the purchased travel pass, less the number of days used (excluding Saturdays, Sundays and public holidays) and a 10% administration fee.
Article 16
Fare refunds are issued at authorised points of sale and at the premises of the Carrier's relevant departments.
The Carrier's vehicle crew may not issue fare refunds.
Ticket sales staff may issue fare refunds.
Where a passenger has purchased a ticket but is unable to travel on the specified date or at the specified time, the Carrier shall allow the passenger to change the ticket's validity period if the passenger submits the request within the time limit specified in Article 13(2) of these General Conditions.
If the Carrier cancels a scheduled bus departure or the bus is delayed by more than 90 minutes, the passenger has the right to request a full or partial refund.
The Carrier may cancel an occasional transport service no later than 32 hours before departure, without liability for damages, if the minimum number of passengers specified in the offer or occasional transport contract has not registered for the service. In such a case, the passenger is entitled to a full refund of the amount paid.
Article 17
No fare refund shall be issued for a lost ticket or a ticket cancelled after the time limit specified in Article 13(2) of these General Conditions.
A passenger who, through their own fault, travels on a vehicle operated by another carrier rather than the Carrier for which the ticket was purchased shall not be entitled to request a refund of the ticket price from the Carrier.
A ticket that has been altered in any way or damaged is invalid and shall be confiscated upon inspection. The passenger shall be charged the full fare for the route on which they are travelling as well as the applicable penalty.
Article 18
In the event of cancellation of a departure or a delay of more than 90 minutes for a departure from a bus station in domestic road transport, international road transport or transport within the EU with a scheduled transport distance of 250 km, the passenger has the right to choose between:
- continuation or rerouting of the journey to the destination;
- return to the point of departure with a full refund of the fare;
- continuation of the journey with a refund for the uncompleted part of the transport service.
The Carrier shall not be liable for damages referred to in paragraph 1 of this Article if it proves that the interruption, delay or failure to provide the transport service was not caused by its intent or gross negligence, or that the damage was caused by force majeure. The Carrier shall not be liable for damage caused by severe weather conditions, traffic congestion or similar circumstances.
If the journey is interrupted during transport for reasons for which the Carrier is not responsible, the passenger shall lose the right to use the ticket on another of the Carrier's vehicles for the unused portion of the ticket or route.
Article 19
In domestic road transport, international road transport and transport within the EU with a scheduled distance of at least 250 km, passengers have the following rights:
- In the event of cancellation or a delay in departure from a bus station of more than 120 minutes, or in the event of overbooking, the passenger may choose between continuation or rerouting to the destination at the earliest opportunity at no additional cost, or reimbursement of the ticket price and, where appropriate, free return to the first point of departure specified in the contract of carriage at the earliest opportunity.
- This does not apply to passengers holding an open-date ticket without a validated ticket and reservation specifying the date and time of return.
- The passenger must communicate their choice to the Carrier in a verifiable manner within 60 minutes of the circumstances referred to in the preceding paragraph arising.
- In the event of cancellation or a delay in departure from a bus station of more than 90 minutes for a journey scheduled to last more than three hours, the passenger is entitled to a snack or meal and refreshments appropriate to the waiting time, provided they are available at the bus station or can reasonably be supplied, as well as a hotel room or other accommodation where an overnight stay of one or more nights becomes necessary. The cost of accommodation may not exceed EUR 80.00 per night for a maximum of two nights.
- The Carrier is not required to provide accommodation where the cancellation or delay is caused by severe weather conditions or a natural disaster that compromises the safe operation of the transport service.
In the event of a road accident arising from the provision of a transport service under these General Conditions, the Carrier shall provide passengers referred to in paragraph 1 of this Article with reasonable and proportionate assistance with their immediate practical needs following the accident, including transport, accommodation, food, clothing and first aid. The total cost of accommodation may not exceed EUR 80.00 per passenger per night for a maximum of two nights.
Article 20
For all other cases not covered by Articles 13–19 of these General Conditions, the passenger has the right to submit a written complaint within eight days of the transport service being provided to:
Brioni d.o.o.
Šijanska cesta 4
52100 Pula
Complaints Committee
The Carrier's Complaints Committee shall respond to the passenger in writing within 30 days of receiving the complaint.
Article 21
The Carrier determines the timetable and fares for its transport services and publishes them in an appropriate manner.
The Carrier's fares, including commercial discounts for particular categories of passengers (pensioners, students, pupils, etc.), must be available for inspection at all points of sale selling the Carrier's tickets.
When using a commercial discount, the passenger must prove their identity by means of an identity document or other appropriate document (Brioni card) bearing a valid photograph.
The Brioni card is an identification document used by its holder to prove their status as a pupil, student or member of an association.
The Carrier reserves the right to refuse to issue a travel pass or other ticket to passengers whose conduct causes damage to the Carrier's property or disturbs other passengers or vehicle crew.
Article 22
At the passenger's request, the Carrier shall issue a certificate stating the price of a ticket for the requested route.
The certificate shall be issued at the Carrier's point of sale using the designated form and shall be charged according to the price displayed at the point of sale.
Article 23
If an inspector finds a passenger travelling without a valid ticket, the passenger shall be charged a penalty of HRK 100 and the full fare for the route on which they are travelling.
Passengers must check all details on their ticket when they receive it and immediately report any errors to the sales staff. If the passenger fails to notify the Carrier of an error in a timely manner, the ticket shall be deemed correct.
Article 24
Passengers are responsible for ensuring that they board the correct bus at their departure stop and leave the bus at their final bus station or stop. Passengers may board or leave the bus only at a bus station or stop specified in the timetable, at a location that is safe for both the passenger and the vehicle.
Passengers must arrive at their departure stop at least 10 minutes before departure. If a passenger is late, the Carrier shall have no obligations towards that passenger.
If short breaks are scheduled during the journey, passengers must return to the vehicle within the time specified for the break.
The Carrier is not required to hold the vehicle or wait for a passenger who fails to comply with the specified break time.
The Carrier accepts no liability for damages claimed by a passenger where such damages result from the passenger's failure to comply with paragraphs 2, 3 and 4 of this Article.
Article 25
During the journey, the vehicle crew or inspector may remove a passenger from the vehicle if the passenger:
- disturbs public order or peace on the bus;
- endangers traffic safety;
- interferes with the work of the vehicle crew;
- interferes with the work of the inspector;
- behaves inappropriately towards passengers or vehicle crew.
When a passenger is removed from the journey, the vehicle crew shall also return the passenger's luggage. In such a case, the passenger shall not be entitled to a refund of the fare for the portion of the journey between the point at which they were removed and their final bus station or stop.
If the vehicle crew is unable to remove the passenger without assistance, they may request assistance from the police.
Article 26
Passengers must keep their ticket throughout the entire journey, until reaching their final destination.
If a passenger loses or otherwise ceases to have their ticket, they must purchase a new ticket from the vehicle crew or inspector.
When the driver checks and collects fares, the driver must verify that all passengers hold the appropriate ticket.
A passenger who refuses to pay the penalty and full ticket price for travelling without an appropriate ticket shall be removed from the journey.
Article 27
The following persons shall not be accepted for transport:
- persons carrying firearms, except passengers carrying them in the performance of official duties, provided the weapon is secured;
- persons showing obvious signs of an infectious or mental illness, as well as persons with open wounds (except where a person injured in a road accident is being transported to the nearest healthcare facility);

Article 28
Smoking on the bus is prohibited. This prohibition also applies to e-cigarettes.
Article 29
If a passenger intentionally or through gross negligence soils the bus, they shall be required to pay the actual cost of cleaning the vehicle.
The passenger must compensate the Carrier for any damage caused through their fault.
Article 30
During the journey, passengers seated in seats fitted with seat belts must wear them in accordance with the applicable Road Traffic Safety Act.
Passengers must not move around the vehicle or leave their seats while the vehicle is in motion and must wait until the vehicle has stopped for passengers to disembark.

The Carrier is entitled to refuse boarding to a passenger who does not possess the documents required to enter a particular foreign country. If the passenger objects to such a decision, the Carrier shall notify the Croatian Ministry of the Interior (MUP) as soon as possible.
The Carrier accepts no liability for damages claimed by a passenger where such damages arise as a result of the passenger's failure to comply with paragraph 1 of this Article.
The Carrier accepts no liability for damages arising from delays caused by inspections carried out by the competent state authorities in accordance with applicable regulations.

Hand luggage generally includes smaller items such as handbags, bags, shopping bags and similar items that can be placed on the shelf above the passenger's seat or kept with the passenger or under the seat, provided that they do not inconvenience other passengers.
No carriage fee is charged for hand luggage referred to in paragraph 2 of this Article, and the vehicle crew shall not be liable for its loss or damage.
Article 34
Passenger luggage includes suitcases, bags, backpacks and similar items with a maximum approximate weight of 25 kg per item of luggage, and a carriage fee shall be charged.
Accompanied items not considered passenger luggage include items carried by the passenger, such as crates, baskets, sacks, packages, bicycles, child car seats and similar items which, due to their dimensions and weight, can be placed in the luggage compartment. Such items shall be charged in accordance with the applicable price list.
Passengers intending to transport a bicycle must notify the Carrier at least 48 hours before the start of the journey.
No fee shall be charged for the transport of wheelchairs, pushchairs or child car seats where the persons using them are travelling in the vehicle as passengers.
At the passenger's request, the Carrier may accept up to two items of luggage, or more where sufficient luggage space is available and the vehicle is not overloaded.
When accepting and storing luggage, the vehicle crew must issue the passenger with an appropriate receipt and luggage tag. The luggage tag must be attached to the luggage, and the passenger/sender shall receive the corresponding receipt. The Carrier determines the price list for the carriage of passenger and unaccompanied luggage and other items, which is displayed at the Carrier's points of sale.
The existence of a contract for the carriage of passenger luggage or items may only be evidenced by the luggage tag and receipt.
Article 35
Notwithstanding Articles 33 and 34 of these General Conditions, no separate luggage fee shall be charged for occasional passenger transport.
A passenger may submit two items of luggage for such transport, or more if sufficient luggage space is available and this does not excessively load the vehicle.

Article 37
The Carrier shall be liable for loss of or damage to accompanied and unaccompanied passenger luggage and other items up to the amount of EUR 350.00.
The Carrier shall not be liable for damage referred to in paragraph 1 of this Article where the passenger luggage is unpackaged or inadequately packaged and is, due to such deficiencies and its nature, exposed to loss or damage.
Article 38

Dangerous substances, explosive or highly flammable items, items with an unpleasant odour, perishable goods, corrosive items or items that may injure or soil passengers, damage the bus or other passengers' belongings accepted for transport, fragile items, cash, securities, valuables, jewellery or works of art shall not be accepted as luggage.

Article 41
Where sufficient space is available in the vehicle's luggage compartment, the Carrier may accept unaccompanied luggage for transport on domestic services.
Unaccompanied luggage means items that are not accompanied by a passenger in the vehicle and which the Carrier accepts for transport with an accompanying document and delivers to the agreed destination stated on the luggage tag and receipt.
Under a contract for the carriage of unaccompanied luggage, the Carrier undertakes to transport the accepted luggage to the agreed destination and hand it over to the recipient or a person authorised by the recipient (a person holding the recipient's power of attorney).
The luggage tag for unaccompanied luggage shall state the price and route and the first name, last name and address of the sender and recipient. The sender's and recipient's names and addresses may also be stated on the consignment itself.
The vehicle crew shall confirm acceptance of unaccompanied luggage by issuing a receipt to the sender when the service is paid for. Upon delivery, the recipient shall confirm receipt of the consignment by signing the copy of the transport document held by the vehicle crew.
The existence of a contract for the carriage of unaccompanied luggage may be evidenced only by the ticket issued for the unaccompanied luggage.

The recipient must meet the bus in order to collect the unaccompanied luggage. The Carrier shall not be liable for unaccompanied luggage if the recipient fails to meet the bus.
The Carrier may store unaccompanied luggage that has not been collected in the bus station's luggage storage facility at the expense of the recipient or sender.
